The Cherokee Nation has also filed a Risperdal lawsuit against the drug company. The complaint states that J&J failed to reveal the increased risks of stroke and diabetes in elderly patients taking Risperdal.

1,700 Risperdal lawsuits have been consolidated

In Philadelphia, 1,700 Risperdal lawsuits have been consolidated to form a mass tort program by the Court of Common Pleas. All of these cases claim that the drug caused breast development and other serious side effects. Janssen is accused of hiding information about the risks and failing to warn doctors and patients about the possible complications.

Louisiana sued J&J

Louisiana sued J&J for off-label marketing of Risperdal, which resulted in the submission of false Medicaid claims. The court awarded $257.7 in civil fines, $3 million in expenses and $70 million in legal fees. In January 2014, the Louisiana Supreme Court did not uphold the false claims charge because the state false claims law only concerns health-care provider claims.

J&J’s misleading advertisements

Arkansas complained that J&J’s misleading advertisements violated the state Medicaid false claims act and consumer protection laws. The court awarded the state $1.19 billion for false claims, $11 million for consumer protection violations, $181 million in legal fees and about $300,000 in expenses. In March 2014, the Arkansas Supreme Court did not uphold the false claims violations. Arkansas Attorney General Dustin McDaniel has filed a petition to re-examine the original charges.
